Scope and Introduction
The Provider Selection Regime requires each Relevant Authority to publish a summary of their application of the regulations. This paper outlines NHS South West London Integrated Care Board’s (SWL ICB’s) summary of all contracts awarded using the Provider Selection Regime (PSR) between 1st April 2025 and 31st March 2026.
In line with Regulation 25; the report will outline a summary of:

- Details of any reviews conducted by the Independent Patient Choice and Procurement Panel including (total requests made to the Panel, the number of requests accepted and rejected as well as the number of times where the Panel advised the RA to re-run or go back to an earlier step in the process and the number of times the advice was followed).
In line with Regulation 26; relevant authorities must monitor their compliance with the PSR regulations. The results of this must be published online annually and must outline their compliance with processes, decisions made under PSR, contract modifications and declaration and management of conflicts of interest.
SWL ICBs compliance report is outlined below. This report is grouped thematically with appraisal with the tenets of PSR Regulation with a summary of identified actions as appropriate.

Summary of Representations
During the period of April 2025-March 2026, NHS SWL ICB received two Representations.
One case was resolved locally with a Representation panel set up to review the provider representation in line with the PSR regulations. Following this review, the provider was made aware of the final panel response to uphold the original decision. No further challenges/representations were made or escalated to the NHS England Independent patient choice and procurement panel (IPCPP), so the Representation was closed.
The second case was referred to the NHS England Independent Patient Choice and Procurement Panel (IPCPP) following a local review undertaken in accordance with the Provider Selection Regime (PSR). The IPCPP did not accept the request on the grounds of prioritisation.

Compliance with PSR processes
SWL ICB has robust governance arrangements, including engagement with the London Commercial Hub to oversee and assure compliance throughout the procurement lifecycle. Implementation of a procurement checklist ensures consistency of understanding and approach
The Contracting and Procurement Group (CPG) provides the first stage of governance approval, supported by the Procurement Oversight Group (POG).
POG has multidisciplinary representation from Finance, Quality, Safeguarding, Contracting, Information Governance, and Procurement teams, ensuring procurement decisions are subject to comprehensive organisational scrutiny and assurance.
Formal meeting structures aligned to the ICB scheme of delegation and reservation requirements supports regular oversight of PSR proposals and timely contract award decisions.
Decisions made under the PSR
Compliant: SWL ICB has established robust arrangements to ensure that the most appropriate route to market is selected for all commissioning and procurement activity undertaken under the Provider Selection Regime (PSR).
Before any procurement process begins, the ICB reviews and challenges service specifications and commissioning intentions to ensure the proposed route to market is proportionate, compliant, and aligned with the Provider Selection Regime (PSR). This is supported by specialist advice from the NHS London Commercial Hub, alongside regular cross-functional review sessions involving Procurement, Finance, and Contracting colleagues to provide early scrutiny and risk mitigation
Decisions are documented through formal meeting governance structures
Contract Modifications
SWL ICB’s process for contract is compliant with Regulation 13.
Modifications are subject to appropriate governance oversight and approval processes, with Transparency Notices routinely published for modifications exceeding £500k
Appropriate scrutiny is applied in relation to the criteria in which modifications are permitted. The nature of the modification (to assess and assure that the change does not materially alter the scope of the contract), financial threshold of the modification vs the lifetime value of the contract is reviewed prior to endorsement at the ICB’s CPG/POG.
Declaration and Management of Conflicts of Interest
Compliant: All Staff are required to complete their declaration of interests online. In addition to a further recording of conflicts at all meetings and stages of procurement.
